Terms And Conditions With Jason Alexander and Crosstown Photo

Herein Jason Alexander and/or Crosstown Photo LLC will be referred to as “The Photographer” and the model/subject of photography or the party employing photographic services as “The Client”. I understand that Jason Alexander is the official photographer retained to perform photographic services requested on this contract.

Deposit > Terms and Conditions

The Client’s booking deposit is non-refundable three weeks prior to the agreed session date and becomes part of the final payment amount due. If a cancellation occurs on behalf of The Client, the deposit will made available for use within 12 months succeeding the cancellation date. This deposit may be applied to a new booking within these 12 consecutive months following the cancellation. This only applies to cancellations made 48 hours in advance. Cancellations made after 48 hours before the date of the session, or on the day of The Client’s scheduled appointment, will result in a loss of deposit. Deposits are only refundable if the session is cancelled by The Photographer and a rescheduled session cannot be made. Please note: session rates are subject to change over the course of time. The current rate at the time of The Clients new appointment must be honored by The Client. For example, if The Client cancels a session in December and reschedule in October of the following year the current rate being offered by Jason Alexander Photography at that time will be the new rate applied to The Client’s session.

Photographer + Client Agreement

Usage by The Photographer

The Photographer retains all rights to copyright and the unlimited right to usage of all photographs made during The Client’s session. The Photographer may publish, distribute, resell, and license rights to these photographs per their discretion, without permission from The Client. This is not limited to the use of photographs on the web, including Facebook, business cards, or posters. By signing this agreement The Client acknowledges that these photographs (digitally or in print) may be seen by anyone in the world and may not be protected from others attempting to download and save them. If The Client has knowledge that someone other than Jason Alexander is using these photographs for any purpose, The Client agrees to contact The Photographer to help facilitate the resolve of this issue.

Copyright

I understand and acknowledge that The Photographer is the sole copyright owner of all photographs made during this session. Therefore, I attest and confirm that any digital or print version of these photographs delivered to me by The Photographer are meant for personal portfolio use only. The Photographs delivered to me, The Client, (digitally and in print) cannot be resold, licensed, distributed, or published without permission from The Photographer, in writing. I, The Client, understand that the fee associated with the session is solely meant to cover The Photographer’s time and creative efforts, only. Obtaining the usage rights to these photographs can be done by contacting the photographer and paying an additional usage fee. Copyrights to any photographs may be discussed by contacting The Photographer directly, however is not guaranteed.

High-resolution photographs are for The Client’s personal printing needs only. In the case of submission to publication, low-resolution photographs bearing The Photographer’s logo must be used. The Client does not have permission to distribute high-resolution photographs to anyone at anytime. The Client has permission to publish said low-resolution photographs on their own personal social media sites, such as Facebook and Instagram. The Client may not distribute or publish photographs, in digital or print form, on any other website or publication without permission from The Photographer, in writing.

Limited Liability

The Client understands that they are hiring the photographer based on their specific highly-stylized approach and has seen portfolio examples prior to booking with the photographer. Any failure by The Photographer to deliver any specific photograph shall not be a breach of this agreement, shall not result in a refund to the client of any money paid to The Photographer, and The Photographer shall not provide any other remedy to The Client.

The Photographer takes the utmost care and respect when creating said photographs. This includes but is not limited to the exposure, processing, post-production, retouching, lighting, and delivery of all photographs. In the event that The Photographer fails to fulfill their obligations under the agreement, The Photographer shall not be liable for any amount of funds past the amount paid in this contract. The initial session fee paid by The Client will represent the full amount of damages due to The Client. This limitation of liability shall also apply in the event that the digital negatives are damaged, lost through mail or transit, or damaged through camera malfunction, or by any other means arising under or related to this agreement.

Injury Liability
The Client is liable for their own personal well-being upon signing this contract. In the unlikely event that injuries to The Client are suffered during the scheduled session, The Photographer is in no way responsible, financially or otherwise. The Client understands that they have the right to decline requests from The Photographer if their well-being is in harms way. In addition, The Client cannot hold the venue in which the session takes place responsible for any injuries that may occur during the session.
